New York State Bar Association Applauds Legislature’s Approval of the Power of Attorney Bill

Scott M. Karson, president of the New York State Bar Association, issued the following statement today regarding the power of attorney bill.
“The power of attorney bill approved by the state Legislature provides long-overdue changes to the state’s overly complex short form. The association has strongly advocated to change this law. The amended statute eliminates the unduly burdensome exact wording requirement in favor of a more user-friendly standard. We thank Assembly member Helene Weinstein and Senator Brad Hoylman for their efforts as the lead sponsors of this legislation. The bill allows damages for unreasonably refusing to honor a properly executed short form power of attorney; and affords protection to those who rely on that form. These important changes will ensure that consumers will be able to carry out their responsibilities when acting as a power of attorney. We will strongly urge the governor to sign this bill.”
