Tools to Allow Litigators to Move Along Their Matters and How to Protect Client Data

On January 19th and January 20th, the Commercial & Federal Litigation Section will virtually bring together commercial litigators from all over the state for a memorable and unique Annual Meeting.

First, on the evening of Tuesday, January 19th, Section members will get together for a virtual reception with the Second Circuit Court of Appeals and for its annual membership meeting.

Then, on the afternoon of Wednesday, January 20th, the Section will host its Annual Meeting CLE. The first panel will discuss how attorneys can take advantage of court-sponsored ADR programs, special masters, and can utilize other tools available to them to move along their cases in the pandemic-affected court system.

The second CLE session will address how data privacy is impacting commercial litigation. The panel will discuss the increasing number of cyber breach lawsuits being filed along with steps that attorneys can take to protect client data in a world where hackers are looking to law firms and where data privacy is of growing importance.

The Section’s 2021 Annual Meeting will finish with a unique networking session where attorneys will have direct contact with state and federal court judges in Zoom breakout sessions.

In light of budget cuts in the state court system and a general backlog of cases in both state and federal courts as a result of COVID-19, attorneys and their clients are exploring new ways to move along and resolve pending matters.

This panel will address different strategies, including the following:

  • Overview of Court-Sponsored ADR Programs and how attorneys can utilize ADR to more efficiently resolve their matters
  • Working with Special Masters and Magistrate Judges to resolve disputes
  • Taking advantage of changes in court rules and practices, including virtual hearings, to keep cases moving ahead

How Cybersecurity and Data Privacy Obligations Are Impacting Commercial Litigators

It has become an ongoing challenge for law firms and attorneys to protect client data. Ethics rules, outside counsel guidelines, case law, and privacy regulations – both domestic and international – may impose obligations on how data is transferred, collected, stored, and used.

Once data is inside the firm’s network – whether it is clients, third-parties, or adversary data – various obligations to secure that data may trigger. And with hackers increasingly targeting law firms, the threats of inadvertent or impermissible exposure is real. Attorneys must be on guard. This panel will address issues including:
