Estate Planning for the Young Professional

Every young professional, shortly after landing his or her first job, and especially if starting a family, must engage in estate planning. The decision to execute estate planning documents can be stressful and overwhelming but doing so is essential for the personal and financial well-being of a young professional. The goal of this program is to educate young lawyers on various planning documents, the benefits of having these safeguards in place, and the potential consequences of being without them under New York law. We will cover the following estate planning tools: Power of Attorney, Health Care Proxy, Living Will, Last Will and Testament, and Beneficiary Designations.

The panelists will offer valuable nuts-and-bolts advice on launching your firm, formulating and executing on a marketing strategy to comply with the NYS Rules of Professional Conduct, getting clients and developing strong attorney and client relationships, surviving the pandemic and shifting a small firm to a virtual platform, and will spin some cautionary tales. Whether you have recently launched a small practice of your own or have dreamt of doing so, this will be a lively and informative discussion.

Antitrust 360 and Me

As a young lawyer, it can be difficult to find your niche. Antitrust law is an interdisciplinary practice area that affords practitioners the flexibility to work broadly across civil and criminal matters, including litigations, investigations, and transactions or, alternatively, to specialize in a particular space. Eva Cole is a litigation partner in Winston & Strawn’s New York office and co-chair of the firm’s Antitrust/Competition Practice Group.

Eva regularly represents clients in complex commercial class action and litigation, and in connection with a wide array of federal and state antitrust issues, including monopolization, price-fixing, wage-fixing, no-poach agreements, group boycotts, exclusive dealing, tying, price discrimination, predatory pricing, unfair competition and other restraints of trade. She regularly coordinates joint defense group efforts in cases involving conspiracy claims against multiple defendants.

Eva also has significant experience representing clients facing international cartel investigations and related follow-on civil class actions. She has helped clients navigate the difficult web of facing multiple, simultaneous government investigations around the world and has experience defending antitrust investigations brought by antitrust authorities in the United States, Australia, Brazil, Canada, the Czech Republic, Europe, Hungary, Japan, Korea, Mexico, Singapore and New Zealand. She represents clients in both civil and criminal antitrust matters and, in addition to her representation of major U.S. and multinational corporations, she also represents individual executives facing criminal antitrust claims.

In this context, Eva has gained a great deal of experience assisting Japanese clients and is a core member of the firm’s Japan practice. Over the years, she has developed a deep and enduring respect for Japanese traditions and Japan’s unique business climate. She ensures that any client – whether in Japan or another part of the world – receives the same level of service as a client down the street. Over the course of his career in public service, David personally litigated and supervised hundreds of complex investigations and cases involving healthcare fraud, bribery, government fraud, computer fraud, securities fraud, bank and wire fraud, mortgage fraud, identity theft, tax fraud, civil rights violations, and environmental violations. He has tried a dozen federal cases of both criminal and civil violations, on both the prosecution and defense side.

Rob went to law school at Hofstra School of Law, where he was a member of the law review, was on the dean’s list every semester, earned awards in both property and criminal law, and graduated magna cum laude. Rob then earned a master’s degree at New York University School of Law, studying how technology and intellectual property influence, and often restrain, competition.

Heather educates the legal profession on issues of diversity, equity, and inclusion.  She writes a monthly column for The Daily Record, called “The Inclusive Office” and frequently presents CLEs on cultural competence and humility.  While working for The Legal Aid Society of Rochester, N.Y., she created and co-chaired its Diversity, Equity, and Inclusivity Committee.  Heather is actively involved in the Rochester Monroe County Domestic Violence Consortium’s Diversity Committee, where she helped develop curriculum for trainings and proposed a project to identify the types of top-level demographic information collected from clients by members agencies as well as the data itself to identify gaps in service.

In 2015, Heather was awarded the Women’s Bar Association of the State of New York (“WBASNY”) Doris S. Hoffman Outstanding New Lawyer Award. Heather was named an “Excellence in Law: Up-and-Coming Attorney” by The Daily Record in 2014 and a SuperLawyers Rising Star in 2014 through 2020. In 2019, Heather participated in the Shriver Center Leadership for Justice Program.

Heather joined Greater Rochester Association for Women Attorneys (“GRAWA”) in 2012. She served as cochair of GRAWA’s Newly Admitted Women Attorneys Committee. She served as GRAWA Membership Chair in 2013 – 2014 and 2014 – 2015, during which period GRAWA reached 300 members for the first time. Heather also served as Co-Chair of WBASNY’s Membership Committee during 2014-2015, 2015-2016, and 2016-2017, when WBASNY reached record membership numbers. She has also served as co-chair of WBASNY’s Convention, Press & Public Relations, LGBT, and Domestic Violence Committees. In 2019-2020, Heather served on the WBASNY Board of Directors as Recording Secretary.  Heather currently serves as GRAWA’s Treasurer.

Heather is a proud resident of the city of Rochester, but returns frequently to Buffalo to spend time with her family, especially her niece, Nora.
