The International Dispute Resolution (IDR) Committee was formed in 2013 for the purpose of focusing attention on issues of special interest to New York practitioners and neutrals active in international arbitration, international mediation and related cross-border litigation.
Issues of current interest to the IDR Committee related to international arbitration include enforcement of international arbitration agreements and awards in New York courts; the availability of anti-suit injunctions and provisional remedies in general in aid of international arbitration; litigation in foreign courts to prevent arbitration in New York; limits on discovery in international arbitration conducted in New York; the impact of discovery practice in federal and state court on the global perception of New York as an international arbitration center; key substantive law principles that distinguish New York law from the substantive law of other international arbitral centers; confirmation of international arbitration awards in the New York courts; mediation of international disputes.
The IDR committee, in cooperation with the Mediation Committee and the joint International Mediation Subcommittee, plans to support educational programs related to the scope and types of international mediation, including private and intergovernmental disputes; the strengthening of the cross-cultural communication skills of international mediators; and the development of methods to utilize the pre-existing, diverse cultural practices of participants to enhance the likelihood of a successful mediation.
