New York State Bar Association Opposes Rollbacks in Discovery Reform, Calls for Issue To Be Handled Post Budget
4.14.2023
Sherry Levin Wallach, president of the New York State Bar Association, issued the following statement on reports about changes to discovery reform being considered as part of ongoing state budget negotiations:
“The New York State Bar Association in principle opposes rollbacks to the 2019 changes to the state’s discovery statutes, which were intended to bring additional transparency and fairness to the criminal justice system. We are unable to comment on the specifics of what the governor has proposed, as negotiations are taking place behind closed doors. Due to the importance of this issue and its widespread impact, it is critical that all impacted stakeholders have an opportunity to weigh in and have a full and public debate. As such, we strongly urge legislative leaders and the governor to remove discovery reform from the budget discussions and address it during the post-budget session.”
