The Covid Crisis and Nursing Home Reform

The New York State Bar Association (NYSBA) is examining why a disproportionate number of residents died from COVID-19 in nursing homes and long-term care facilities across the state.
Nearly 6,700 coronavirus deaths occurred in nursing homes in New York State, the most of any state. According to the New York Times, 40% of all coronavirus deaths in the United States are linked to nursing homes and they account for 7% of all the cases in the country.
NYSBA has launched a series of webinars addressing issues in long-term care, and particularly what has led to the disastrous impact of COVID-19 and what reforms are needed. This program will lay out the fundamentals of the nursing home industry: its legal structure, oversight, funding and ownership, and the realities of enforcement. The presenters will discuss issues with staffing, infection and quality control, profit vs. non-profit ownership, and the debates over liability and immunity that have become so heightened during the COVID-19 pandemic. In August, NYSBA created the Task Force on Nursing Homes and Long Term Care to study this timely issue. Its deliberations are ongoing.
