Border Searches and Digital Forensics: What Lawyers Need to Know
In Digital Forensics and Border Searches, we will cover the technology and the current state of the law behind searches of electronic devices at the border and while in law enforcement custody. We will give an overview of the different tools available, their capabilities, and the sometimes conflicting laws governing their use. Additionally, we will discuss the thorny issues and sometimes unforeseen problems of cloud storage and social media. The use of social media continues to grow, as does its potential value as a source of evidence. Simultaneously, people are increasingly storing private and personal data in “the cloud”, sometimes without even knowing it. We will cover the ways in which this data can be obtained, the protections that exist, and the options for your client.
