Program Description
Our panel of experienced matrimonial law practitioners and actuaries guide you through the highly technical and often challenging topic of qualified retirement plans from a matrimonial law perspective. This program will initially cover the basic requirements for domestic relations orders and discovery materials needed for proper identification and understanding of provisions of the underlying plan. Additionally, the panel will provide a brief overview relative to the taxation of retirement plans and responsibility for taxation on distribution and possible tax pitfalls. The main focus of the program will provide a comprehensive overview of various retirement plans including defined benefit plans, qualified pre-retirement survivor benefits, post-retirement survivor benefits, and whether or not the order can provide for a shared or separate interest benefit. In addition, panelists will discuss defined contribution plans and IRAs and provide sample language for DROs/ agreements and IRA transfers. Finally, program faculty will present recent decisions, new legislation and developing trends in matrimonial law – popular program favorites.
